HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.29189 OF 2017 ORDER :

This writ petition is filed seeking writ of mandamus declaring the proceedings in Ref.No.E1/813(1)/2017-PO-II, dated 30.06.2017 issued by the 2nd respondent, as illegal and arbitrary.

It is the case of the petitioner that he was transferred from Rajahmundry to Srikakulam vide proceedings dated 30.06.2017 issued by the 2nd respondent and petitioner made representation on 07.7.2017 stating that his wife is working at Rajahmundry as a Teacher in Municipal Corporation of Rajahmundry under medical grounds and she is suffering with ailments and that his daughter is also studying at Rajahmundry.

On the other hand, Sri S.V.Ramana, learned Standing Counsel for the respondent Corporation submits that since petitioner is long standing person working at Rajahmundry, he was transferred on administrative reasons. It is to be seen that the grievance of the petitioner is already been placed before the competent authority by way of representation dated 07.07.2017, it is for the competent authority to consider the same.

In view of the same, the 2nd respondent is directed to consider the representation of the petitioner dated 07.07.2017 in accordance with the Rules within a period of two weeks from the date of receipt of a copy of this order. Till disposal of representation, proceedings dated 30.06.2017 shall remain stayed.

With the above direction, this writ petition is disposed of. There shall be no order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending in this writ petition shall stand closed.
