THE HON'BLE SRI JUSTICE SANJAY KUMAR AND THE HON'BLE SRI JUSTICE N. BALAYOGI WRIT PETITION No. 6033 of 2015 ORDER: (per Hon'ble Sri Justice Sanjay Kumar) The Union of India and its Postal Authorities filed this writ petition aggrieved by the order dated 22.08.2014 passed by the Central Administrative Tribunal, Hyderabad Bench, in O.A.No.931 of 2014. By the said order, the Tribunal directed the authorities to withhold a sum of Rs.74,519/- till completion of the enquiry proceedings and release the remaining amounts to the first respondent herein within a time frame. The authorities were further directed to complete the enquiry proceedings expeditiously. By order dated 04.06.2015, this Court granted interim suspension of the order passed by the Tribunal. W.V.M.P.No.3009 of 2015 was filed by the first respondent to vacate the aforestated order.

Heard Sri B. Venkateswarlu, learned counsel representing Sri B. Narayana Reddy, learned Assistant Solicitor General for India appearing for the petitioners, and Sri Dantu Srinivas, learned counsel for the first respondent.

Sri Dantu Srinivas, learned counsel, brought it to our notice that the disciplinary proceedings initiated against his client were dropped thereafter. A copy of the Memo dated 13.02.2017 issued by the Superintendent of Post Offices, Kurnool Division, Kurnool, was produced in evidence of this fact. Perusal thereof reflects that the charge memo dated 24.04.2014 issued to the first respondent was dropped due to administrative reasons.

In that view of the matter, the authorities have no basis to withhold the retiral benefits of the first respondent. They shall accordingly release the same expeditiously.

The writ petition is accordingly dismissed. Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
