HONOURABLE SRI JUSTICE U.DURGA PRASAD RAO CRIMINAL PETITION No.2604 OF 2018 ORDER:

This Criminal Petition is filed under Section 482 Cr.P.C by the petitioner/accused seeking to quash the proceedings against him in Crime No.44 of 2018 of Mangalagiri Police Station, Guntur District, registered for the offences under Sections 323, 506 and 509 of I.P.C. Section 3(1) (r) (s) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Amendment Act, 2015. Investigation is reported to be pending.

The complaint allegations, in brief, are that the complainant has been a party member in T.D.P.party Women's Cell and on 27-2-2018 at about 9 hours, when she went to the house of one Ganji Chiranjeevi where the accused was present and during the course of conversion, he abused her in the name of her caste in filthy language and also slapped her. Investigation is reported to be pending.

Having regard to the prima facie accusation contained in the complaint, it is not apposite to quash the proceedings at this stage. Therefore, the investigation shall be continued to its logical conclusion.

This Criminal Petition is dismissed accordingly. As a sequel, miscellaneous applications pending if any, shall stand closed.
