Heard Mr.Mir Masood Khan for petitioner, Mr.Dharmesh DK Jaiswal for respondents 2 and 3 and Mr.K.Arun Kumar for respondent No.5.

The petitioner prays for Mandamus declaring that the respondents have no right to refuse the petitioner from attending, appearing and participating in Annual General Meetings, Special General Meetings etc. sponsored or conducted by HCA/ BCCI as against bye laws, articles and intent of Memorandum of Association.

I have perused papers in O.P. No.1106 of 2012. After perusing the papers in O.P. No.1106 of 2012, this Court is of the view that a lis is pending between the petitioner and the 5th respondent as to who is entitled to represent before the HCA. Since the lis is pending before the learned II Additional Chief Judge, City Civil Court, Hyderabad, this Court is of the view that the consideration of the prayer at present without proper adjudication by the competent Court is unnecessary. Therefore, the writ petition is disposed of by giving liberty to petitioner and 5th respondent to work out their rights in O.P. No.1106 of 2012, and subject to the outcome of O.P. No.1106 of 2012, the 2nd respondent will permit the successful party to attend, appear and participate in Annual General Meetings, Special General Meetings etc. No order as to costs.
