THE HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.9576 of 2021 ORDER:

This Writ Petition is filed for the following substantive relief: "... to issue a Writ or Order or direction more particularly one in the nature of Writ of Mandamus declaring the action of respondent authorities in not considering the petitioner's written representation dated 16.3.2021 made pursuant to the notification issued by respondent No.3 vide notification No.A2/386/2017 dated 27.3.2018 for the post of Anganwadi teacher and Mini Anganwadi teachers under direct recruitment without passing any orders, is nothing but illegal, arbitrary, abuse of process of law and in violation of principles of natural justice and contrary to the Rules and consequently, to direct the respondent authorities to consider the written representation of the petitioner dated 16.3.2021 and pass appropriate orders."

Heard Sri Md. Chand Pasha, learned counsel for the petitioner, and learned Government Pleader for Women and Child Welfare appearing for the respondents.

It has been contended by the petitioner that the respondents have issued recruitment notification on 27.3.2018 for the posts of Anganwadi teacher and Mini Anganwadi teacher; that as she was fully eligible and qualified for the said post, she applied for the same and appeared in the written examination; that she along with others have appeared before the respondents for certificates verification; that her name appeared in the selection select; and that thereafter, the respondents have not completed the entire procedure as per the notification. She further contended that she has submitted a detailed written representation to the respondents on 16.3.2021

requesting them to consider her case for the post of Anganwadi teacher by duly taking into account her performance in the selection process. The grievance of the petitioner is that so far, the respondents have not passed any orders on the written representation dated 16.3.2021 submitted by her. Hence, the present Writ Petition is filed.

Learned counsel for the petitioner contended that appropriate orders be passed in the Writ Petition directing the respondents to consider the written representation submitted by the petitioner on 16.3.2021 and pass appropriate orders in accordance with law.

Learned Government Pleader appearing for the respondents contended that since the petitioner's representation is pending before the respondents, they would consider the same and pass appropriate orders in accordance with law.

This Court, having considered the rival submissions of the learned counsel for both the parties, is of the considered view that the Writ Petition can be disposed of directing the respondents to consider the petitioner's written representation dated 16.3.2021 and pass appropriate orders in accordance with law as expeditiously as possible, preferably, within a period of eight weeks from the date of receipt of a copy of this order. Subject to the above direction, the Writ Petition is disposed of. There shall be no order as to costs.
