HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION NO:13446 OF 2005 ORDER:

1. This writ petition is filed challenging the inaction of the respondent in considering the applications of the petitioners for grant of pension under Swatantra Sainik Samman Pension Scheme.

2. A counter was filed on behalf of the respondent stating that as the petitioners submitted their applications to the respondent directly, the recommendations and verification reports of the State Government have not been received and therefore, the claim of the petitioners has not been considered so far.

3. Considering the above facts and circumstances, this Writ Petition is disposed of with the following direction:

"The respondent is directed to send the applications filed by the petitioners to the State Government concerned for getting its recommendations, if any, within a period of three months from the date of receipt of a copy of this order. The State Government concerned is also directed to consider the petitioners' applications that would be sent by the respondent, and forward its recommendations, if the petitioners are eligible for pension under Swatantra Sainik Samman Pension Scheme." No order as to costs. Consequently, the miscellaneous petitions pending, if any, shall stand closed.
