HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No. 5849 of 2004 ORDER:
This writ petition is filed seeking to issue a writ of mandamus declaring the action of the respondent in not providing any employment to the petitioner on compassionate grounds, as illegal and arbitrary.
When the matter is taken up for hearing, learned counsel for the petitioner submits that though the petitioner is entitled for compassionate appointment, the respondent is not considering the case of the petitioner for compassionate appointment. A perusal of the record discloses that the petitioner is aged about 50 years. At this point of time, the case of the petitioner cannot be considered for compassionate appointment.
Accordingly, the writ petition is dismissed. Consequently, miscellaneous petitions, if any, pending in the writ petition shall stand closed. No order as to costs.
