A Rajeshwar v. B. Venkateshwarlu
THE HONOURABLE SRI JUSTICE M.S.RAMACHANDRA RAO C.C.No.1875 of 2014 ORDER :
This Contempt Case is filed alleging willful disobedience of the order dt.02.09.2014 passed by this Court in WP.No.15871 of 2014.
2. In the said order this Court directed the Assistant Commissioner of Endowments, Nizamabad to administer Oath of Office to petitioners in the respective temples pursuant to orders dt.01.03.2014 passed by the Commissioner of Endowments within 10 days from the date of receipt of a copy of the order.
3.
Though in the counter-affidavit filed by 2nd respondent, it was pleaded that a petition to review the order passed in the Writ Petition has been filed and it is also pleaded that there was some doubt entertained as to whether Oath can be administered after the order is passed by the Court, it is now stated by both sides that Oath was administered to petitioners by 2nd respondent recently.
The 2nd respondent has also tendered unconditional apology in the counter-affidavit filed by him.
4. In view of these circumstances, I am of the opinion that it is not a fit case to punish 2nd respondent for willfully disobeying this order. Therefore, the Contempt Case is closed. No order as to costs.
5.
As a sequel, miscellaneous petitions pending, if any in this Contempt Case, shall stand closed.
