THE HON'BLE SRI JUSTICE A. SHANKAR NARAYANA TRANSFER CMP.No.204 of 2018 ORDER:

In the present transfer petition, the petitioner - husband is requesting to withdraw O.P.No.55 of 2015 from the file of the Judge, Family Court, Kadapa, and to transfer the same to the Judge, Family Court, City Civil Court at Secunderabad, on the main ground that he is residing at Hyderabad, where he is employed, and, therefore, it is difficult for him to travel to Kadapa.

In case the petitioner is really facing such inconvenience, he would have come at the inceptive stage itself, but not at this stage and, that too in the original petition filed by him under Section 9 of the Hindu Marriage Act, 1955, for restitution of conjugal rights. There is no merit in the present petition.

Hence, the present transfer CMP is dismissed. However, keeping in view, that the original petition relates to the year 2015, the learned Judge, Family Court, Kadapa, is directed to dispose of the same i.e., O.P.No.55 of 2015 itself, as expeditiously as possible, not later than six months from the date of receipt of a copy of the order. Miscellaneous Petitions, if any, pending in the present petition, stand closed.
