Bhogoju Chandra Sekhar v. Osmania University,
THE HON'BLE SRI JUSTICE P. NAVEEN RAO WRIT PETITION No.8865 OF 2017 Dated:15.03.2017 Between:
Bhoguju Chandra Sekhar, S/o. late Purushotham, aged About 59 years, Occ: Mechanic III, University College of Engineering, Mechanical Department, Osmania University, Osmania Campus, Hyderabad .. Petitioner And Osmania University, rep., by its Vice Chancellor, Osmania University Campus, Osmania University, Hyderabad and others .. Respondents The Court made the following:
THE HON'BLE SRI JUSTICE P. NAVEEN RAO WRIT PETITION No.8865 OF 2017 ORDER:
Petitioner alleges that he was appointed as Mechanic III on 24.07.1990 on daily wages at Nizam College, Hyderabad, and thereafter was transferred to Engineering College, Mechanical Department, Osmania University on 30.11.2000. He further alleges that he has been continuously working and will be attaining the age of superannuation on 30.04.2017. He claims that though he made several requests, latest being representation dated 12.12.2016, and even though he is eligible, his entitlement for regularisation is not considered by the authorities concerned. He further contends that unless such claim is accepted, benefits thereof would not be granted to him and due to which, he would suffer irreparable loss after he attains the age of superannuation, even though he has rendered more than 25 years of service. Hence, this Writ Petition.
2.
When the matter is taken up for consideration, learned counsel for the petitioner fairly submits that since representation, dated 12.12.2016, filed by the petitioner is pending, if a direction is issued to the respondents to consider the said representation and pass appropriate orders thereon before his attaining the age of superannuation, it would suffice the interest of the petitioner. 3.
Having regard to the said submission and without expressing any opinion on the merits of the case, the Writ Petition is disposed of directing the Registrar, Osmania University,
Hyderabad, the 2nd respondent, to consider the claim of the petitioner as ventilated in his representation, dated 12.12.2016, regarding regularisation of his services, and pass appropriate orders as warranted by law by assigning due reasons in support of the decision, as expeditiously as possible, preferably on or before 30.04.2017, having regard to the claim that he is attaining the age of superannuation on that date and communicate the decision to the petitioner. There shall be no order as to costs. Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
