Heard learned counsel for the petitioner and learned Government Pleader for the respondents.
The petitioner was appointed as a permanent fair price shop dealer for the Shop No.14, Muppalla Village and Mandal, Guntur District. The authorization of the petitioner is subsisting. While so, the 4th respondent inspected the shop on 08.05.2015 and found some variations in the stock. Based on the same, Section 6A proceedings were initiated. Thereafter, show cause notice was issued by the 2nd respondent on 25.05.2015 and on the same day, the authorisation of the petitioner was suspended pending enquiry. Challenging the same, the petitioner filed the present writ petition. Learned counsel for the petitioner submitted that when he filed W.P.No.15348 of 2015, it was not intimated by the learned Government Pleader with regard to the issuance of order of suspension and now the order of suspension is issued with antedate.
On the other hand, learned Government Pleader submits that earlier instructions in June, 2015 contain issuance of show cause notice dated 25.05.2015 and though there was no mention with regard to the order of suspension, on the same date the order of suspension was issued on the said date only.
Be that as it may, in view of the nature of the allegations, this Court is not inclined to interfere with the enquiry process at this stage. The 2nd respondent is directed to complete the enquiry within a period of 30 days from the date of receipt of a copy of this order.
With the above direction, the writ petition is disposed of. There shall be no order as to costs.
Pending miscellaneous petitions in this Writ Petition, if any, shall stand closed in consequence.
