THE HON'BLE SRI JUSTICE A.V. SESHA SAI CIVIL REVISION PETITION No.3050 of 2016 ORDER:

This Civil Revision Petition filed under Article 227 of the Constitution of India assails the docket order, dated 14-06-2016 passed by the Court of the Principal Junior Civil Judge, Penukonda, Ananthapur District in I.A.No.256 of 2016 in O.S.No.115 of 2016.

As per the provisions of Order 43 Rule 1 (r) of Code of Civil Procedure there is an alternative remedy of appeal against impugned order, therefore, this Court is not inclined to entertain the present revision in view of the said alternative remedy of appeal.

For the aforesaid reason, the Civil Revision Petition is dismissed, however, with a liberty to the petitioner herein to assail the impugned order by way of availing the alternative remedy as indicated supra. Office to return the originals. The Miscellaneous Petitions, if any, pending in this Civil Revision Petition shall stand closed. There shall be no order as to costs.
