This writ petition is filed to declare the proceedings in Crime No.521/2016/P&EX/A-3 dated 08.09.2016 on the file of Respondent No.2 herein as arbitrary, illegal and contrary to Section 45 of A.P.Excise Act 1968, besides violative of principles of natural justice and equity and further be pleased to set aside the same and consequently to release the DCM Van No.AP 36 TA-9936 along with the seized stock of jaggery in petitioner's favour pending the case bearing Crime and occurrence report No.436/2016 on the file of the Respondent No.3.

When the matter is taken up for hearing, learned Government Pleader produced proceedings No.Cr.No.521/2016/P&Ex/A3 dated 28.11.2016 whereunder, the order confiscating the seized property is passed. 3.
Since the property in issue is already confiscated, petitioner has to work out his remedies, as available in law, if so advised, against the said order.

Leaving it open to the petitioner to work out his remedies as available in law, against the confiscation orders, the Writ Petition is dismissed. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
