HON'BLE SRI JUSTICE S. RAVI KUMAR C.R.P No.789 of 2016 ORDER:
This revision is preferred questioning order dated 15.12.2015 in I.A No.1637 of 2015 in RCA No.1 of 2015 on the file of Senior Civil Judge-cum-Appellate Authority under Rent Control Act, Proddatur.
2. Revision petitioners herein filed RCA No.1 of 2015 questioning the eviction order passed by the Principal Junior Civil Judge-cum-Rent Controller, Proddatur in RCC No.1 of 2012 and in that appeal they filed I.A.No.1637 of 2015 seeking stay of execution of the order. Appellate court on a consideration of material on record dismissed the application holding that petitioners are not entitled for the stay and questioning the same, present revision is filed.
3. Heard both sides.

Admittedly, Principal Junior Civil Judge-cum-Rent Controller, Proddatur passed eviction orders in RCC No.1 of 2012 on the ground of default in payment of rents. The said order is challenged before appellate authority and the said appeal is pending, which is of the year 2015.
5. Now both sides submitted instead of deciding this revision on merits, a direction may be given to the appellate court to dispose of main appeal within a stipulated time on merits.
6. Considering the submissions of both sides without going into merits of the case, Senior Civil Judge-cum-Appellate authority
under Rent Controller Act, Proddatur shall take up RCA No.1 of 2015 and dispose of the same on merits within two (02) months from the date of receipt of a copy of this order without being influenced by any of the observations made in I.A.No.1637 of 2015 in his order dated 15.12.2015, and till disposal of the appeal, there shall be interim stay of execution of eviction order passed by the Principal Junior Civil Judge-cum-Rent Controller, Proddatur.
7. Accordingly, this Civil Revision Petition is disposed of. No costs. Miscellaneous petitions, if any pending, in this Revision shall stand closed.
