Heard the learned counsel for the petitioner and the learned Government Pleader for Civil Supplies.
The petitioner was appointed as fair price shop dealer of Vegarlapalli village, Madakasira Mandal of Anantapur District by proceedings in R.C.No.4415/93 (H), dated 28.07.1994. The petitioner applied for leave for a period of six months, i.e., from August, 2014 to February, 2015. The respondents considered the said request and made alternative arrangements by allotting stock to the neighbouring shop dealer. Thereafter, when the stock was not released to the petitioner's fair price shop, the present writ petition is filed. The learned Government Pleader received instructions, which do not reveal the suspension or cancellation of authorization. The instructions state that the Tahasildar received a representation from the petitioner on 27.02.2015 that after expiry of the leave, her health condition is good and requested for supply of essential commodities. In the circumstances, so long as the authorization of the petitioner is valid and in force, the respondent Nos.2 and 3 shall continue to supply the stock for distribution of the same to the card holders.
Accordingly, the writ petition is allowed. There shall be no order as to costs. As a sequel, the miscellaneous petitions, if any pending in this writ petition, shall stand closed. _________________________ A.RAMALINGESWARA RAO, J Date: 22.06.2015 siva
