THE HON'BLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.35084 of 2016 ORDER:

The writ petition is filed by the petitioners seeking a writ of mandamus declaring the action of the fifth respondent, at the instance of the respondents 7 to 16, in insisting the petitioners to vacate from their agricultural landed property admeasuring Acs.5.10 cents in Survey No.1090/4 of Parimipudi Revenue Village in Koyyalagudem Mandal of West Godavari District as illegal, arbitrary and without any authority of law.

Heard and perused the material.

Learned counsel for the petitioners submits that the fifth respondent is harassing the petitioners at the instance of respondents 7 to 16 and as such, interfering with the affairs of the petitioners without therebeing any complaint against the petitioners. Learned Assistant Government Pleader for Home (Andhra Pradesh) submits that a complaint is registered being F.I.R.No.250 of 2016 against the petitioners herein for various offences and the fifth respondent is conducting investigation in accordance with law. Considering the rival submissions made by both the counsel, the writ petition is disposed of with a direction to the fifth respondent not to harass the petitioners in the name of investigation and to follow the due process of law.

The writ petition is accordingly disposed of. Consequently, miscellaneous petitions, if any shall also stand disposed of. _____________________ JUSTICE RAJA ELANGO 19.10.2016 pln
