HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 46303 of 2016 ORDER:

1) Heard learned counsel for the petitioner and Government Pleader for Revenue. With consent of both the parties, the writ petition is being taken up for disposal at the admission stage itself.

2) The present writ petition came to be filed seeking issuance of writ of mandamus declaring the action of the second respondent in not disposing of the R.O.R. appeal vide File No.G/ 1908/ 2010 filed against the proceedings No.ROR/ 08/ 2008, dated 22.10.2008, as arbitrary, illegal and violation of principles of natural justice.

3) Though various grounds are raised in the writ petition, the grievance of the petitioner is that though the appeal was filed in the year 2010 till date no orders passed in the appeal. 4) The Government Pleader for Revenue submits that a direction may be issued for an early disposal of the appeal. 5) Without going into the merits of the case and having regard to the arguments advanced, the present writ petition is disposed of, directing the second respondent to dispose of the R.O.R. appeal vide File No.G/ 1908/ 2010 filed against the proceedings No.ROR/ 08/ 2008, dated 22.10.2008, after hearing all the concerned including the petitioner, in accordance with law, as expeditiously as possible, preferably, within a period of three (03)

months from the date of receipt of a copy of the order, if the same is still pending. There shall be no order as to costs. 6) Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
