THE HONOURABLE SRI JUSTICE RAJA ELANGO Criminal Petition No.5594 of 2016 ORDER:

This Criminal Petition is filed under Section 482 of Code of Criminal Procedure (Cr.P.C) by the petitioners/accused seeking to quash the proceedings in M.C. No.1 of 2016 on the file of the Sub-Divisional Magistrate, Vijayawada, Krishna District. Heard the learned counsel for the petitioners/accused and the learned Public Prosecutor and perused the material available on record.

After arguing for sometime, the learned counsel for the petitioners, while not pressing for the main prayer, confined his arguments only to the extent of dispensing with the presence of the petitioners before the trial Court.

In any event, considering the nature of allegations against the petitioners-accused, presence of the petitioners-accused before the trial Court is dispensed with except on the dates of framing of charges, examination under Section 313 Cr.P.C. and pronouncement of the judgment. However, the petitionersaccused shall be properly represented through their counsel before the trial Court. The trial Court is directed to conclude the trial as expeditiously as possible preferably within a period of six months from the date of the receipt of a copy of the order

Accordingly, the Criminal Petition is disposed of. Consequently, the miscellaneous petitions pending in this petition, if any, shall stand closed.
