THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.6915 of 2018 ORDER:

This Writ Petition is filed challenging the action of the 4th respondent in issuing an endorsement on 13.11.2017, rejecting the request of the petitioner for allotment of land under ex-serviceman quota, on the ground that the land in Survey No.216 is recorded as Government land.

The case of the petitioner is that he joined the service of military in the year 1997 and retired in the year 2013. After retirement, he settled in Repalle, Guntur District. The petitioner submitted an application on 04.12.2013 for allotment of Government land and the Zilla Sainik Welfare, Guntur, also recommended his case. When there was no action, the petitioner filed W.P.No.27563 of 2016 and the said Writ Petition was disposed of on 22.08.2016 directing the 4th respondent to pass appropriate orders. Pursuant to the said order, now an endorsement was passed by the 4th respondent stating that though the land in Survey No.216 is a Government land, it cannot be assigned in favour of the petitioner.

Since the 4th respondent rejected the request of the petitioner, the petitioner can approach the higher authority against the said endorsement. No relief can be granted in the present writ petition. 4.

Accordingly, giving liberty to the petitioner to approach the higher authority against the endorsement made by the 4th respondent, this Writ Petition is disposed of.
