This writ petition is disposed of at the stage of admission with the consent of both the parties.
This writ petition is filed seeking the following relief :- " ..... to issue an appropriate Writ, Order or Direction, more particularly one in the nature of Writ of Mandamus to declare the inaction of the 2nd respondent in passing orders in the appeal filed on 13.12.2018 against the suspension orders passed in O.O.No.E/ 6057/ 2018-2019 dt.20.9.2018, in spite of the personal visits followed by reminders dt.11.3.2019 and 29.3.2019 as being illegal, arbitrary and unjust and consequently direct the 2nd respondent to dispose of the appeal petition dt.13.12.2018 as expeditiously as possible ......" .
Heard Mr.C.Bhargava Sharma, learned counsel for petitioner and the learned Government Pleader for Services-I. It has been contended by the petitioner that he is working as Junior Assistant with the respondents and the disciplinary authority has placed him under suspension on 20.09.2018. Aggrieved by the same, he has preferred an appeal before the 2nd respondent on 13.12.2018. In spite of repeated reminders on 11.03.2019 and 29.03.2019, the appellate authority has not disposed of the appeal so far.
Learned counsel for the petitioner has contended that appropriate orders be passed in the writ petition directing the 2nd respondent to dispose of the appeal preferred by the petitioner on 13.12.2018 in accordance with law.
Learned Government Pleader appearing for the respondents has contended that the 2nd respondent would consider and dispose of the appeal preferred by the petitioner on 13.12.2018 in accordance with law.
This Court, having considered the rival submissions, is of the considered view that this writ petition can be disposed of directing the 2nd respondent to consider and dispose of the appeal preferred by the petitioner on 13.12.2018, in accordance with law, within a period of four weeks from the date of receipt of a copy of this order.
With the above observations, the writ petition is disposed of. No order as to costs.
