No. 411 of 2018 JUDGMENT:- (ORAL) (Per Hon'ble Sri Justice Suresh Kumar Kait) The present application is filed seeking to condone the delay of 311 days in filing the writ appeal.

A perusal of the averments made in the accompanying affidavit discloses that the only explanation submitted by the petitioner-appellant for the delay is that he could not approach this Court within reasonable time for filing the writ appeal due to paucity of funds.

It is not in dispute that the petitioner-appellant was reinstated into service in the year 2012 and continued in the service, therefore, the explanation offered by the petitioner cannot be accepted. No other reasons are assigned explaining the delay in filing the appeal.

Hence, we find no ground to condone the inordinate delay of 311 days in filing the appeal.

Hence, the application dismissed, and consequently, the writ appeal is rejected. No order as to costs. As a sequel, Miscellaneous Petitions, if any pending, shall stand disposed of as infructuous.
