This Criminal Petition is filed under Sections 480 & 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS') by the petitioner/Accused No.3 seeking to enlarge her on bail in connection with Crime No.22 of 2026 on the file of Bijinapally Police Station, Nagarkurnool, registered for the offence under Section 103 (1) read with 3 (5) of the BNS. 2.

Heard Sri Bhavani Sankar, learned counsel for the petitioner and Sri M.Ramachandra Reddy, learned Additional Public Prosecutor, appearing for the respondent-State.

The case of the prosecution is that the de facto complainant lodged a complaint before police on 29.01.2026 wherein it is stated that on 29.01.2023 at about 3:00 PM when her husband working in the agricultural fields at Karkonda Village, the accused persons picked up a quarrel with him due to previous disputes. It is alleged that A.2 caught hold of her husband and A.1 attacked him with an axe and caused bleeding injuries. It is stated that the complainant immediately went to the scene of offence and shifted her husband and reported the same to the police. Basing on the same, police registered a case for the aforesaid offence one week after the incident and summoned the witnesses.

Learned counsel for the petitioner would submit that in the initial complaint, there are no allegations against the petitioner herein. But, basing on the statement of the deceased person, the petitioner herein was arrayed as accused No.3 stating that she beat the deceased with hands and abused deceased in filthy language which amounts to an offence punishable under Section 103 of BNS; that the petitioner has been in judicial custody for the last one month

- 3 - without any allegation against her and therefore, he requested this Court to grant regular bail to the petitioner. 5.

On the other hand, learned Additional Public Prosecutor opposed the same and submits that though there is no mention of name of the petitioner by the de facto complainant in the complaint, basing on the statement of the deceased, who is husband of the complainant she was arrayed as accused No.3; that there are specific allegations against the petitioner; that A.1 to A.4 hatched a plan to kill the deceased which itself attract the ingredients of Section 103 of the BNS; that investigation is not yet completed; that as the offence alleged against the petitioner is grievous in nature, the petitioner is not entitled for grant of bail and hence, he prays to dismiss the petition.

Considering the submissions made by both the counsel and on perusal of the material on record, the petitioner has been in judicial custody since 18.02.2026. As seen from the record, the specific allegation against the petitioner is that accused No.3 beat the deceased with hands. However, considering the fact that the petitioner is a woman,

- 4 - this Court deems it fit to grant regular bail to the petitioner/accused No.3 subject to the following conditions: (i) The petitioner-Accused No.3 shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties for a like sum each to the satisfaction of the learned II Additional Judicial Magistrate of First Class, Nagarkurnool.

(ii) On such release, the petitioner-accused No.3 shall appear before the concerned SHO at 11:00 a.m. and 5:00 p.m., on every Wednesday for a period of eight (8) weeks or till filing of charge sheet whichever is earlier, for the purpose of investigation, and thereafter, as and when required.

(iii) The petitioner-Accused No.3 shall abide by the conditions stipulated in Section 437 (3) of Cr.P.C. (presently, Section 480 (3) of BNSS).

Accordingly, the Criminal petition is allowed. Miscellaneous petitions, if any, pending shall stand closed.
