ORDER

This Criminal Petition is filed under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS') for grant of pre-arrest bail to the petitioner, who is arrayed as accused in Crime No.441 of 2025 before the Kalwakurthy Police Station, Nagarkurnool District, registered for the offences punishable under Sections 85 and 108 of BNS.

The brief facts of the case are that the case arises out of a complaint dated 07.12.2025 wherein the complainant alleged that his sister, who was married to the petitioner about 18 years ago, was subjected to continuous harassment by the petitioner on suspicion of her character and due to his habit of coming home in a drunken condition. It is further alleged that on the same day, the complainant received information from neighbours that his sister had died under suspicious circumstances at her residence. Based on the said complaint, F.I.R. No.441 of 2025 was registered by Kalwakurthy Police Station initially under Section 194 BNS and later altered to Sections 85 and 108 of BNS.

Heard Sri P. Subash, learned counsel appearing on behalf of the petitioner as well as Sri M. Ramachandra Reddy, learned Additional Public Prosecutor appearing on behalf of the respondent - State. 4.

Learned counsel for the petitioner submitted that the petitioner is innocent of the said allegations and he do not have any criminal antecedents and son and daughter of the accused and deceased stated that she committed suicide by hanging herself due to the financial crisis, as such, the petitioner cannot be blamed and he was falsely implicated in the present case, and no material exists to connect him with the alleged offence and that though the alteration report refers to panchayats and prior disputes, no statements of elders or material witnesses have been recorded. He further submitted that the custodial interrogation is not required as no recovery is to be made and the petitioner was not present at the time of the incident.

Therefore, he prayed the Court to grant pre-arrest bail to the petitioner by allowing this Criminal Petition.

On the other hand, learned Additional Public Prosecutor opposes the grant of anticipatory bail contending that the allegations disclose continuous harassment of the deceased by the petitioner, which ultimately led to her death under suspicious circumstances and that the investigation is in progress and the role of the petitioner needs to be thoroughly examined. He contended that considering the nature of allegations, custodial interrogation may be necessary. At this stage, the petitioner is not entitled for the pre-arrest bail. Hence, he prayed the Court to dismiss the criminal petition.

In the light of the submissions made by both the learned counsel and on a perusal of the material available on record and considering the facts and circumstances of the case and also considering the statements of the children of the deceased, this Court deems it fit to grant pre-arrest bail to the petitioner, subject to the following conditions: i.

The petitioner shall surrender before the Station House Officer, Kalwakurthy Police Station, Nagarkurnool District, within two weeks from today, and on such surrender, the said Station House Officer shall release him on bail on executing a

personal bond for Rs.25,000/-, with two sureties, for the like sum each.

ii.

The petitioner shall abide by the other conditions stipulated in Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023 and co-operate with the Investigating Officer in investigating the case. iii.

The petitioner shall appear before the concerned Investigating Officer on every Monday between 09:00 a.m, and 05:00 p.m., for a period of 8 weeks or till the filing of the charge sheet, whichever is earlier, and thereafter, as and when required.
