THE HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.8749 of 2016 ORDER:

This Criminal Petition is filed by the petitioner/A-2 under Section 438 Cr.P.C. seeking anticipatory bail in Crime No.70 of 2016 on the file of Badvel (U) Police Station, Kadapa District, registered for the offences punishable under Section 370(A)(2) I.P.C., and Sections 3,4, 5 and 5A of the Immoral Traffic (Prevention) Act, 1956.

2. Heard and perused the material available on record.

3. Case of the prosecution is that the petitioner herein is procuring innocent girls to the brothel house of A-1 for the purpose of prostitution.

4. Learned counsel for the petitioner submitted that the petitioner is innocent of the offences alleged against him and he has been falsely implicated in the present case; that the petitioner will cooperate with the investigation and will not flee from the hands of police.

5. Learned Additional Public Prosecutor opposed to grant bail to the petitioner.

6. The petitioner is introducing innocent girls to A-1, who in turn, is involving them in prostitution in his brothel house. There are other cases pending against the petitioner. Hence, this Court is not inclined to grant anticipatory bail to the petitioner.
