THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.23812 of 2015 ORDER:
Learned Assistant Government Pleader for Social Welfare fairly concedes that the issue raised in this writ petition is squarely covered by the decision of this Court in W.P.No.23764 of 2013. A copy of the order dated 21.08.2013 passed in the said writ petition is placed on record.
For reasons alike as were mentioned in the aforestated order, the writ petition is disposed of in terms thereof as under: Since the Community, Nativity and Date of Birth certificate issued by the Tahsildar dated 08.07.1998 is admittedly still in force, the respondents shall within two days from the date of receipt of a copy of this order, furnish the petitioner a OBC certificate. It is made clear that this order shall not preclude the respondents from initiating action under Section 5 of the Andhra Pradesh (SC, ST & BCs) Regulation of Issue of Community Certificates Act, 1993, for cancellation of the caste certificate in favour of the petitioner, if they are of the view that the said caste certificate is false.
