HON'BLE SRI JUSTICE SURESH KUMAR KAIT Civil Revision Petition No.5612 of 2010 ORDER:

The present petition was filed questioning the order, dated 24-09-2010 in I.A.No.681 of 2010 in I.A.No.296 of 2010 in O.S.No.1405 of 2010 on the file of the IV Junior Civil Judge, City Civil Court, Hyderabad, whereunder the petition filed by the petitioner/proposed party under Order-I, Rule 10 read with Section 151 C.P.C. seeking to implead him as defendant No.2 in the suit was dismissed.

As informed by the Registry of this Court that while ordering notice before admission on 03-12-2010, this Court granted interim stay and on 01-02-2013, Civil Revision Petition was admitted and the same is pending for disposal.

As per the Computer record, the suit O.S.No.1405 of 2010 itself was disposed of on 30-11-2010. The learned counsel for the petitioner does not dispute the same. Accordingly, the Civil Revision Petition is dismissed as infructuous. However, the petitioner is at liberty to take steps before the Court below as per law, if so advised. No order as to costs.

Miscellaneous petitions, if any, pending in this Civil Revision Petition shall stand closed.
