HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NO. 2172 OF 2022 O R D E R:

This criminal petition is filed under Sections 437 and 439 of the Code of Criminal Procedure, 1973 (for short "Cr.P.C.") seeking to enlarge the petitioners/Accused Nos.2, 3 and 4 on bail in connection with Crime No.30 of 2022 on the file of the Station House Officer, Moinabad Police Station, Cyberabad, registered for the offence punishable under Section 304-part II, 341, 506, IPC.

Heard the learned counsel for the petitioner and learned Assistant Public Prosecutor for the respondent-State and perused the record. 3.

Briefly stated, the case of the prosecution is that on 19.01.2022, Accused Nos.1 to 4 while travelling from Chevella to Aziznagar restrained the deceased and beat him with hands and legs resulting in the deceased receiving severe bleeding injuries and was admitted in the hospital and thereafter died on 25.01.2022.

Learned Counsel for petitioners submits that A1 was already released on bail vide Crl.MP.No.730/2022 in Cr.No.30/2022, dt.25.03.2022 by the VIII Additional District & Sessions Judge, Ranga Reddy District at L.B.Nagar.

The case appears to be one of road rage and the punishment prescribed for the offence under Section 304 Part-II is up to ten years and no minimum sentence is prescribed.

In view of the aforesaid circumstances, I am inclined to grant bail to the petitioners/A2 to A4.

In the said circumstances, the petitioners/Accused Nos.2 to 4 are directed to be released on bail on their executing personal bond for Rs.10,000/- (Rupees Ten Thousand only) each with two sureties each for likesum to the satisfaction of the XVI Additional Metropolitan Magistrate, Cyberabad, Rajendranagar. The petitioners shall appear before the Investigating Officer as and when called for the purpose of investigation. 7.
