HON'BLE SMT. JUSTICE KONGARA VIJAYA LAKSHMI WRIT PETITION No. 8166 OF 2013 ORDER :
This Writ Petition is filed to declare the action of the respondent Nos. 1 and 2 in issuing notice of eviction dated 18.2.2013, as illegal and arbitrary and a consequential direction was also sought not to evict the petitioner from the premises by conducting the auction in respect of Shop Nos. 11 & 12 near Library, Municipal Council, Tandur without following due process of law. Learned standing counsel for the 2nd respondent submits that the extension of lease can be granted only twice and as two years term has already been expired by 31.03.2013, the petitioner was asked to vacate the premises. He further submits that by the impugned notice, the petitioner was informed that the auction would be held so as to come into effect from 01.04.2013.
There is no interim direction in the Writ Petition. Having regard to the facts and circumstances of the case and due to efflux of time, the matter has become infructuous.
