HON'BLE SRI JUSTICE C.V.NAGARJUNA REDDY AND HON'BLE SRI JUSTICE M.S.K.JAISWAL WRIT PETITION No.7417 of 2016 Date:28.4.2016 Between:

D.Venkatesham, S/o Ramchandraiah and 14 others.

....Petitioners And:

The Commissioner of Intermediate Education, State of Telangana, Hyderabad and 38 others.

.....Respondents Counsel for the petitioners: Mr. Srinivasa Rao Madiraju Counsel for Respondent Nos.7 to 22: K.Raghavendra Venkatesh The Court made the following:

ORDER: (per Hon'ble Sri Justice C.V.Nagarjuna Reddy) This Writ Petition is filed for a Certiorari to quash order, dated 31.12.2015, in Original Application No.4710 of 2015 on the file of the Andhra Pradesh Administrative Tribunal, Hyderabad (for short 'the Tribunal').

The above-mentioned O.A.

was filed by respondent Nos.7 to 22 (hereinafter referred as "the contesting respondents") to declare the inaction of the official respondents herein in taking steps to review their promotions and also that of others, who are promoted on adhoc basis, consequent on the judgment of the Tribunal striking down the integration of Z.P. Management and Government sector teachers, which was confirmed by this Court. By the impugned order,

the Tribunal has disposed of the said O.A. Feeling aggrieved by the said order, the private respondents in the said O.A. filed this Writ Petition.

The applicants in the said O.A., who are the contesting respondents, filed WPMP.No.13448 of 2016 for passing appropriate order in the Writ Petition.

In the affidavit, filed in support of the said application, it is inter alia averred that they understand that they are within the zone of consideration for promotion; that there are several vacancies; and that therefore, they are not interested either in opposing the Writ Petition or in allowing the order of the Tribunal impugned in this Writ Petition to exist and that, accordingly, they would like to withdraw the O.A. itself.

At the hearing, Mr. K.Raghavendra Venkatesh, learned counsel for the contesting respondents, reiterated the plea raised by his clients that they would like to withdraw the O.A. itself.

Having regard to the facts pleaded by the contesting respondents in the counter-affidavit referred to above and the submission of their counsel, the O.A.

itself is permitted to be withdrawn and the same is, accordingly, dismissed with the direction that the order, dated 31.12.2015, in O.A.No.4710 of 2015 shall not enure to the benefit of the contesting respondents as the same would not work against the interests of the writ petitioners.

Subject to the above observation, the Writ Petition is disposed of.

As a sequel to disposal of the Writ Petition, WPMP.Nos.9481 and 13448 of 2016 are disposed of as infructuous.
