THE HON'BLE SRI JUSTICE M.S.K.JAISWAL Writ Petition No. 38748 of 2012 ORDER:
The writ petition is filed to declare the action of the respondents in not granting any pension under the Freedom Fighters Scheme to the petitioner in spite of the recommendations of the local District Administration, as illegal and unconstitutional, and consequently to direct the respondents to pay the monthly pension along with all other benefits from the date of application with penal interest on the delayed payments and consequential benefits for the freedom fighters.

During the course of hearing it is represented by the learned Government Pleader appearing for the respondents that fresh proposals for sanction of the freedom fighters' pension under 'Swatantra Sainik Samman Pension Scheme, 1980' have been submitted by the State Government to the Under Secretary to Government of India, Ministry of Home Affairs, New Delhi vide Letter No.3569/ DA&LR/ A1/ 2007, dated 04.08.2017. 3.
Since the proposals are sent recently, the writ petition is disposed of with a direction to the 1st respondent to consider the proposals and pass appropriate orders thereon, within a period of three months from the date of receipt of a copy of this order. As a
sequel, the miscellaneous applications pending, if any, shall stand closed. There shall be no order as to costs.
