THE HONOURABLE SRI JUSTICE M.S.RAMACHANDRA RAO CRP.No.4653 of 2014 ORDER :

This Revision is filed challenging warrant of attachment dt.12.06.2014, passed by the Principal Senior Civil Judge, Srikakulam in EP.No.70 of 2014 in O.S.No.149 of 2009 on the file of the said court.

2. The counsel for petitioner stated that the decree dt.19.06.2013 in the said suit was challenged with delay before the District Court and the said appeal was also dismissed; and that a Second Appeal filed by his client is pending.

3. Merely because the petitioner has questioned the judgment of the lower appellate court in Second Appeal, it will not operate as stay of execution of the decree of the trial court. I, therefore, do not find any merit in the Revision and it is accordingly dismissed. No order as to costs.

As a sequel, miscellaneous petitions pending, if any, in this Revision shall stand closed.
