- 2 - THE HON'BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.28960 OF 2017 ORDER :

This writ petition is filed to declare the action of the Revenue Divisional Officer, Kadiri, Anantapur (2nd respondent) in not conducting survey of the land to an extent of Ac.2.36 cents in Sy.No.26/1, Yenumulapalli Village, Puttaparthi Mandal, Anantapur District by deputing the Deputy Inspector of survey, in pursuant to the application of the petitioners dated 13.04.2015 and 10.04.2017, as illegal and arbitrary and contrary to the A.P.Board of Revenue Standing orders; and also to declare the inaction of the 2nd respondent in not adjudicating the validity or otherwise of the endorsement of the 3rd respondent vide proceedings Dated 11.05.2015 in which the 3rd respondent rejected to conduct survey on false and non-existing grounds, on the petition submitted by the petitioners dated 10.04.2017 as illegal, improper and unjust.

Heard Senior Counsel Sri P.Gangaiah Naidu, learned counsel for the petitioners and learned Assistant Government Pleader for the respondents.

Even though petitioners sought two prayers, when the matter is taken up, learned senior counsel submits that for the present, petitioners are confining their grievance to the relief "b'" prayed in the writ petition and if a direction is issued to the 2nd respondent to dispose of the appeal filed by the petitioners on 10.04.2017, it would suffice their interest.

Learned Assistant Government pleader, submits that the appeal is pending with the 2nd respondent and he is competent to dispose of the appeal.

Having regard to the said submission, the Writ Petition is disposed of directing the 2nd respondent to consider the appeal preferred by the petitioners and to dispose of the same, as expeditiously as possible, preferably within a period of six (6) weeks from the date of receipt of copy of this order. There shall be no order as to costs.

Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
