THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.16845 of 2009 ORDER:

The grievance of the petitioner is that the respondent authorities are interfering with their property without following due process and trying to demolish their building bearing Door No.8-156 & 57 part, situated in T.S.No.848/1 & 2 of Vizianagaram town. This Court at the stage of admission, on 13.08.2009, granted interim direction directing the respondents not to demolish the petitioners' building without following due process. Now, the learned Government Pleader for the respondents submits that there cannot be any objection for them for making the interim order as a final order.

As it is not the case of the respondents that they would like to take away the property of the petitioner without following due process of law, in those circumstances, the interim order passed by this Court, on 13.08.2009, is hereby made absolute, by making it clear that the respondent authorities shall not interfere with, in any manner, with the subject property of the petitioners, without following due process and without payment of compensation by following due process.

Accordingly, the Writ Petition is disposed of. No costs. Consequently, Miscellaneous Petitions pending, if any, shall stand closed.
