HON'BLE SMT. JUSTICE KONGARA VIJAYA LAKSHMI W.P. No. 11490 of 2015 O R D E R:- This writ petition is filed for the following substantive relief:
" ....to issue a Writ of Mandamus declaring the action of the 1st respondent in not acting on the petitioner's application dated 09.07.2014 for alienating the site on the market value admeasuring an extent of 1,600 square yards in Sy.No. 77 of Kondurg village and Mandal, Mahaboobnagar District belonging to the 2nd respondent - Temple, as arbitrary and illegal." The learned Standing Counsel for Sri Lakshmi Narasimha Swamy Temple appearing on behalf of the 2nd respondent, submits that in view of the order passed by the Division Bench of this Court in W.P.M.P.No. 15055 of 2005 in W.P.No. 11812 of 2005 that no sale and compromise shall be effected with respect to Endowment lands without the permission of the Court, the respondents-authorities are not able to take any action on the petitioner's representation and that no further orders need be passed in the writ petition.
As the order passed by the Division Bench is still in force, no further orders can be passed contrary to the orders of the Division Bench.
Hence, the writ petition is closed as no further orders are necessary. However, liberty is granted to the petitioner
KVL,J WP_11490_2015 to file a fresh application after disposal of W.P.No. 11812 of 2005. No order as to costs.
As a sequel, Miscellaneous Petitions, if any pending, shall stand disposed of as infructuous.
