HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No. 24500 of 2003 ORDER:
This writ petition is filed seeking to issue a writ of mandamus declaring the action of the respondents in rejecting the pension claim of the petitioner and in not considering his representation dated 03.07.2003, as illegal and arbitrary. A consequential direction is also sought to the respondents to consider the representation of the petitioner and grant pension from 01.02.2002. None appears for the petitioner. Heard learned counsel for the respondents.
While admitting the writ petition, this Court directed the respondents to consider and dispose of the representation of the petitioner dated 03.07.2003, vide orders dated 21.11.2003 in WPMP No.30855 of 2003.
When the matter is taken up for hearing, it is brought to the notice of the Court that during pendency of the writ petition, the respondents have rejected the case of the petitioners vide orders dated 10.12.2003.
In view of the above and in the facts and circumstances of the case, the writ petition is disposed of with a direction to the petitioner to submit a representation afresh to the respondents within one week from the date of receipt of a copy of this order and upon receiving such representation, the respondents shall consider the entire case of
the petitioner and pass appropriate orders, within four weeks thereafter, in accordance with law.
