THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.19752 of 2004 ORDER:

Heard the learned Counsel for the petitioner and the learned Government Pleader for the respondents. This Writ Petition was filed challenging the action of the respondents in granting assignment of the tank bed poramboke land of an extent of Ac.1.80 cents in R.S.No.179/1B of Yenuguvani Lanka Village, Elamanchili Mandal in West Godavari District.

A counter affidavit is filed on behalf of respondent Nos.1 to 3 stating that a representation was received from the Scheduled Caste community people of Elamanchili Village requesting for allotment of some land for burial ground to their community people and they requested for allotment of the land in R.S.No.179/1B. But, the said land is a tank bed land and therefore it cannot be allotted for graveyard purpose. The representation was considered and proposals were sent by the Tahsildar, Elamanchili, for allotment of Ac.0.50 cents of land in R.S.No.211 and final orders are not yet issued by the revenue authorities. However, so far as the land in Survey No.179/1B is concerned, there are no proposals for allotment of the said land for graveyard purpose and the request cannot be considered in view of it being a tank bed land.

In view of the said statement made by respondent Nos.1 to 3 in their counter affidavit, recording the same the Writ Petition is closed. The miscellaneous petitions pending in this Writ Petition, if any, shall also stand closed. There shall be no order as to costs.
