THE HON'BLE SRI JUSTICE NOOTY RAMAMOHANA RAO CRIMINAL PETITION No.540 of 2013 ORDER:
None appears for the petitioner. There is no representation on behalf of the petitioner when the matter is taken up. The petitioner herein sought for quashing Crime No.28 of 2013 pending with the Miyapur Police Station, Cyberabad, registered for the offences under Sections 354 and 506 of IPC.
The 2nd respondent herein is the complaint. It is alleged by the 2nd respondent wife that her husband had developed illegal intimacy with the petitioner herein and when she confronted him, she has been subjected to an assault and has been necked out of the home. The petitioner Smt. Hymavathi was the wife of Sri Gollaprolu Srinivas Rao, who worked as a Reserve Inspector of Police and died. Hence, the 2nd respondent wife lodged the complaint with the police. The very petitioner herein has filed Criminal Petition No.496 of 2013 to quash the crime No.119 of 2012 pending with the Mahila Police Station, Vijayawada City, Krishna District, and this Court rejected the same for the reasons recorded in its order dated 15.06.2015. Since a prima facie is made out, I do not see any warrant for quashing crime No.28 of 2013 pending with the Miyapur Police Station, Cyberabad.
Accordingly, this criminal petition is dismissed. Consequently, miscellaneous petitions, if any, pending shall also stand dismissed.
