The petitioner challenged the punishment imposed by the respondent-Corporation postponing annual increment for a period of two years with cumulative effect by raising I.D.No.10 of 1999 before the Labour Court, Warangal, and the Labour Court vide award dated 20.8.2001 dismissed the I.D. Challenging the same, the present writ petition is filed. 2.

The learned Counsel for the petitioner submits that appropriate orders may be passed directing the respondents to release the increments by modifying the punishment of postponement of annual increment for a period of two years with cumulative effect to that of without cumulative effect, as this is the lone charge in the entire career of the petitioner. 3.

The learned Standing Counsel for the respondentCorporation submits that the Labour Court has rightly dismissed the I.D. preferred by the petitioner and that there are no merits in the writ petition to interfere with the award impugned. 4.

This Court having considered the rival submissions made by the parties is of the view that since the petitioner attained the age of superannuation now and since the charge levelled against the petitioner is the lone charge in his entire career,

ends of justice would be met, if the punishment of postponement of annual increment for a period of two years with cumulative effect is modified to that of postponement of annual increment for a period of two years without cumulative effect.

Accordingly, the Writ Petition is disposed of modifying the punishment of postponement of annual increment for a period of two years with cumulative effect to that of postponement of annual increment for a period of two years without cumulative effect, only for the purpose of terminal benefits. No order as to costs. Miscellaneous petitions pending, if any, shall stand closed.
