THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.13031 of 2012 ORDER:
The issue raised in this writ petition relates to the demand for payment of enhanced stamp duty in connection with the quarrying lease granted to the petitioner.
By order dated 27.04.2012, this Court granted interim suspension as prayed for. Pursuant to such direction, the lease deed is stated to have been executed and the lease period is also over. This Court had occasion to consider this issue in several cases earlier. A copy of the order dated 02.06.2015 passed in W.P.No.3156 of 2012, following the earlier dictum in W.P.No.17660 of 2008 and batch, is produced.
For reasons alike as were stated in the aforestated order and in terms thereof, this writ petition is disposed of leaving it open to the respondent authorities to make a fresh demand for payment of higher stamp duty and registration fee than that already paid by the petitioner company, if warranted, and in the event such demand is made, it would open to the petitioner company to defend itself against such demand and also take recourse to appropriate measures open to it in law.
