At the time when the matter is taken up for hearing, it is brought to the notice of this Court that main suit itself was dismissed for default and that I.A.No.220 of 2016 came to be filed seeking restoration of the same.

It is the case of the petitioner that there is no regular Presiding Officer in the Court of VII Additional District Judge, Madanapalle, where the said application is pending, and the Incharge Officer is not taking up the said matter. Since the matter requires urgent consideration, the petitioner seeks a direction for disposal of the said I.A.

Learned counsel for the respondents would submit that he has no objection for the same, if it is still pending consideration. Having regard to the above, the Civil Revision Petition is dismissed as infructuous, however, the In-Charge Officer of the Court of VII Additional District Judge, Madanapalle, may dispose of I.A.No.220 of 2016 in O.S.No.22 of 2008, in accordance with law, as early as possible preferably within a period of four (04) weeks from the date of receipt of a copy of this order.

CPK,J CRP_4064_2016 Consequently, Miscellaneous Petitions, if any, pending in this Revision shall stand closed. There shall be no order as to costs.
