HON'BLE SRI JUSTICE A. SHANKAR NARAYANA CRIMINAL PETITION No.381 OF 2017 ORDER:
The only request made in the present Criminal Petition, under Section 482 of the Code of Criminal Procedure, 1973, filed by the petitioner - accused No.6 viz., Ravindra Uma Devi, is to relax the condition imposed by the Judge, Family Court - cum - XII Additional District Judge, and Full Additional Charge of II Additional District Judge, Guntur, while granting anticipatory bail to her directing to surrender before the learned VI Additional Judicial Magistrate of First Class, Guntur, on or before 16.11.2016 and on such surrender the learned VI Additional Judicial Magistrate of First Class, Guntur, was directed to release her on bail subject to her executing a bond for Rs.50,000/- with two sureties for a like sum each to the satisfaction of the learned VI Additional Judicial Magistrate of First Class, Guntur.
2. The learned counsel for the petitioner on the ground, that the said condition is onerous, the petitioner is financially unsound and is unable to meet such condition, filed the present petition requesting for relaxation.
3. First of all, the request acceded to by the Judge, Family Court, was pre-arrest bail granted on 02.11.2016 and the direction to the petitioner was to surrender on or before 16.11.2016, but, admittedly, she has not complied with that condition and came to this
ASNJ Crl. P No.381 of 2017 Court seeking to modify the same. When the petitioner has not obeyed the order passed by the Judge, Family Court, it is nothing but disrespecting the Court which has accorded the pre-arrest bail. In such an event, there is no ground to accede to the request of the petitioner.
4. Therefore, the Criminal Petition is dismissed at the admission stage itself.
As a sequel thereto, Miscellaneous Petitions, if any, pending in the Criminal Petition stand closed.
