THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.7055 of 2018 O R D E R:
This writ petition is filed for the following relief: "....to issue writ, order or direction more particularly in the nature of writ of Mandamus declaring the action of the respondent in trying to dispossess the petitioner from premises admeasuring 1600 square yards under Shed No. 24 forming part of the property of the respondent, situated at A.P.
Agro Industries Development Corporation, situated at Sy.Nos. 221, 222, 223, 237, and 33, Quthbullapur Mandal, Ranga Reddy District without following due process of law, as being untenable, arbitrary, and unjust and consequently direct the respondents not to dispossess the petitioner from the premises without following due process of law....." Petitioner is a Gas Agency. It was granted lease on 26.11.2010 for an extent of 1600 square yards of land under Shed No.24, in Survey Nos.221, 222, 223, 237 and 33 of Quthbullapur Mandal, Ranga Reddy District, for the purpose of running its godown. Thereafter, the lease was extended from time to time. While so, the respondent-Corporation issued a notice on 06.09.2017 to the petitioner to vacate the premises by 28.02.2018, as the lease granted in its favour had expired. When the matter came up for admission on 12.03.2018, learned counsel for the petitioner submitted that the petitioner may be granted time for making alternative arrangements. However, learned Standing Counsel for the respondentCorporation submitted that the Corporation has made
arrangements for establishing a Gas Station to ensure maximum revenue to it and three months time may be granted to the petitioner subject to the condition of filing an undertaking before this Court to that effect.
Today, learned counsel for the petitioner filed an undertaking given by Smt.V.Prasanna W/o.T.Rajendra, Partner of the petitioner-Agency stating that the premises would be vacated within six months.
Considering the needs of the respondent-Corporation and the petitioner, this Court accepts the undertaking subject to the modification that the petitioner shall vacate the subject premises by 31.07.2018. The deponent of the undertaking shall bear in mind that non-compliance with the undertaking would expose her to contempt proceedings.
Subject to the above, the writ petition is disposed of. Miscellaneous petitions, if any, pending in this writ petition shall also stand disposed of. There shall be no order as to costs. _________________________ CHALLA KODANDA RAM, J Dt:15.03.2018 kdl
