HONOURABLE SRI JUSTICE S. V. BHATT CIVIL REVISION PETITION No. 7 OF 2015 ORDER:

The plaintiff in O.S.No. 6 of 2004 is the revision petitioner. The revision petition is filed against order in I.A.No. 1867 of 2014 dated 11.12.2014 to reopen the evidence which was closed on 21.04.2014 and permit plaintiff to lead further evidence on the material introduced by the respondents subsequent to the closure of evidence of the revision petitioner/plaintiff. The learned trial Judge having regard to the totality of the circumstances and also the mode and manner in which the respondents were permitted to bring the material on record against which objection is raised by the revision petitioner declined to exercise the discretion and reopen the suit. The suit is of the year 2004. I do not see any illegality or irregularity in the order passed by the learned trial Judge. The

revision petitioner is not prevented under law to urge legal objections if any against any of the circumstances now complained in the affidavit.

The Civil Revision Petition is dismissed. No order as to costs.
