Raja Khan Bagh Mosque Managing Committee v. State Of Ap
HON'BLE SRI JUSTI CE A.RAMALI NGESWARA RAO Writ Petition No.6937 of 2018 Order:
In spite of granting ten days time on 02.03.2018, no instructions were received by the learned counsel for the second respondent. Hence, this Court is constrained to dispose of the Writ Petition at the admission stage, on the basis of the averments made in the affidavit filed in support of the Writ Petition.
It is the case of the petitioner that the second respondent issued proceedings on 07.03.2015 appointing a managing committee for Raja Khan Bagh Mosque of Kadapa City for a period of three years and the period of the said committee came to an end on 06.03.2018. The petitioner submitted a representation on 31.01.2018 seeking extension of the term of the committee and when no orders are passed, the present Writ Petition is filed.
In the affidavit it is stated that the second respondent passed an order on 14.02.2017 taking control of the administration of the Mosque directly and challenging the same W.P.No.6875 of 2017 was filed. In the light of the order passed on 14.02.2017, it is not known how the petitioner can seek extension of the term of the committee. However, without going into the merits of the case, this Writ Petition is disposed of directing the second respondent to consider the representation of the petitioner dated 31.01.2018 and pass appropriate orders in accordance with law within a period of two weeks from the date of receipt of a copy of this order.
As a sequel thereto, the miscellaneous petitions, if any, pending in this writ petition shall stand closed. There shall be no order as to costs. ________________________ A. RAMALI NGESWARA RAO, J Date: 12.03.2018 Nsr
