P.Viswanadha Naidu v. The State Andhra Pradesh
THE HON'BLE SRI JUSTI CE A.RAMALI NGESWARA RAO Writ Petition No.7000 of 2018 Order:
The notice to the respondents 4 to 6 is dispensed with, in view of the nature of disposal of the present Writ Petition. The petitioner states that he filed an appeal on 07.01.2015 under Section 5-A of the A.P. Rights in Land and Pattadar Passbooks Act, 1971 (for short 'the Act') before the second respondent challenging the issuance of pattadar passbooks and title deeds in favour of the respondents 4 to 6. Though the said appeal was numbered as H/102/2015, when no further proceedings were taken, the present Writ Petition is filed.
When the matter came up on 05.03.2018, it was adjourned by ten days in order to enable the learned Government Pleader to get instructions and the learned Government Pleader, on the basis of instructions, submits that the appeal is still pending. In view of pendency of the appeal before the second respondent, this Court is inclined to dispose of the present Writ Petition directing the second respondent to dispose of the appeal filed by the petitioner which was numbered as H/102/2015, as expeditiously as possible, but not later than eight (8) weeks from the date of receipt of a copy of this order, after giving proper notice to the respondents 4 to 6 and the petitioner. The Writ Petition is, accordingly, disposed of. There shall be no order as to costs.
As a sequel thereto, the miscellaneous petitions, if any, pending in this writ petition shall stand closed.
