THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL REVISION CASE No.1617 OF 2004 ORDER:

By judgment dated 4.2.2004 the III Metropolitan Magistrate at Hyderabad in C.C.No.236 of 2002 convicted the accused for the offence under Section 138 of Negotiable Instruments Act and sentenced to undergo S.I. for six months and to pay a fine of Rs.3,000/-, in default, to suffer S.I. for one month. Not satisfied with the quantum of sentence of imprisonment imposed on the accused and since no compensation is awarded, the present revision is preferred by the complainant.

When the matter is taken up for hearing, it is brought to the notice of this Court that the accused has preferred an appeal challenging the conviction and sentence imposed by the trial Court and the lower appellate Court set aside the sentence of imprisonment while confirming the fine amount. Hence, nothing survives for adjudication in this revision.

Hence, the Criminal Revision Case is dismissed as infructuous.

Pending Miscellaneous Petitions, if any, shall stand closed.
