Petitioner suffered an order of eviction under Section 6 of the A.P. Land Encroachment Act passed by the third respondent on 03.06.2015 in Rc.B.No.133/2014. An appeal against the same is stated to have been pending before the second respondent since 16.06.2015 along with a stay petition. Apprehending threat of dispossession, the petitioner filed the present writ petition alleging that the stay petition at least is required to be heard on priority, as the third respondent is threatening to execute the order of eviction.

2. Heard learned counsel for the petitioner and learned Government Pleader for Revenue.

3. Keeping in view the facts and circumstances of the case, it is appropriate and desirable that the second respondent fixes an early date for hearing of the stay petition in the aforesaid appeal and passes appropriate orders on or before 22.08.2015. Pending consideration of the stay petition before the second respondent, status quo, existing as on today, shall be maintained by the petitioner as well as the third respondent. The writ petition is disposed of. As a sequel, the miscellaneous applications, if any, shall stand closed. There shall be no order as to costs.
