HONOURABLE SRI JUSTICE V.RAMASUBRAMANIAN AND HONOURABLE SRI JUSTICE P.KESHAVA RAO WRIT PETITION No.8434 of 2019 ORDER: (Per Hon'ble Sri Justice V. Ramasubramanian) The petitioner has come up with the above writ petition challenging a conditional order passed by the Debts Recovery Tribunal, for the grant of stay.

2. At the time when the writ petition came up for admission on 23.04.2019, we passed the following order:

"Notice before admission returnable by one week. Personal notice is permitted.

There will be an interim stay of dispossession subject to the condition that the petitioner pays the first installment of 10% on or before 21.05.2019.

Post immediately after Summer Vacation, 2019."

3. But till date, the conditional order has not been complied with. In other words, even 10% of the amount due, which was directed to be paid as a first instalment, could not be paid by the petitioner. In such circumstances, we do not see any justification to interfere with the conditional order passed by the Tribunal. Hence, the writ petition is dismissed.

Miscellaneous applications pending, if any, shall stand closed. No costs.
