HON'BLE SRI JUSTICE S.V.BHATT W.P.No.23821 OF 2009 ORDER:

There is no representation for petitioner in the forenoon as well as in the afternoon.

Heard learned standing counsel for 2nd respondent. The petitioner prays for Mandamus declaring inaction of respondents in considering the candidature of petitioner for the post of Associate Professor in Geography (SC) notified on 27.01.2009, as illegal and unconstitutional.

On 05.11.2009 in WPMP.No.30953 of 2009, this Court passed the following interim order:

"There shall be a direction to the respondentUniversity to consider the representation dated 25.08.2009 and pass appropriate orders within a period of two weeks from the date of receipt of a copy of this order."

With the passage of time or that the representation dated 25.08.2009 would have been considered and disposed of by the respondents, the petitioner may not be interested in prosecuting the writ petition.

The writ petition is dismissed for default with liberty to the petitioner to seek for restoration, if the cause subsists for adjudication. There shall be no order as to costs.

Consequently, pending miscellaneous petitions, if any, also stand disposed of.
