ORDER:

Impleadment of respondent No.8 by the lower Court to O.S.No.283 of 2010, filed by respondent Nos.1 to 7 for declaration of title over the suit schedule property, recovery of possession and damages, is assailed in this Civil Revision Petition by defendant Nos.1 to 4.

At the hearing, Mr. N.Sriram Murthy, learned counsel for the petitioners, submitted that the main objection to the impleadment of respondent No.8 is that though he is not a party to the suit, he has joined respondent No.1/plaintiff No.1 in filing I.A.No.938 of 2012 for his impleadment. He however, concedes that a separate application by respondent No.8 alone for his impleadment is

maintainable. In my opinion, when such an application by respondent No.8 is maintainable, I do not find any reason why he should not have joined respondent No.1/plaintiff to file an application for his impleadment.

At any rate, the petitioners being defendant Nos.1 to 4 in the suit, impleadment of respondent No.8 does not in any manner affect their interests or the outcome of the suit. For the above-mentioned reasons, I do not find any merit in this Civil Revision Petition and the same is, accordingly, dismissed.
